Vear provides an "All in one AI" platform that routes user queries and prompts to various third-party AI models (such as OpenAI, Anthropic, DeepSeek, Gemini, Grok, and others) via API. We aggregate these responses and deliver them back to you. When an identical question or prompt is submitted to the exact same AI model as one submitted previously, the Service may provide the previously cached answer. By using the Service, you acknowledge and agree that:

• Your content (including prompts or questions) may be sent to and processed by third-party AI providers under their respective terms and privacy policies.
• Your prompt may be stored for caching purposes, and an identical prompt may generate the same previously cached response to another user.

4. Account Registration and Security

1. Account Creation: To access certain features of our Service, you may need to register an account. You agree to provide accurate, current, and complete information and to keep it updated at all times.
2. Security: You are responsible for maintaining the confidentiality of your login credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized access or use of your account.

5. User Content and Ownership

1. Ownership: You retain all rights and ownership in the content you submit through the Service ("User Content"). Vear does not claim any ownership over your User Content.
2. License to Vear: By submitting User Content, you grant Vear a worldwide, non-exclusive, royalty-free license to store, cache, display, and otherwise use your User Content as necessary to provide the Service. This includes transmitting your User Content to third-party AI providers via API.
3. Third-Party Providers: You acknowledge and agree that the third-party AI providers we integrate with may have their own policies regarding storage, use, or modification of your data. Vear is not responsible for the data practices of these third-party providers.

6. Prohibited Use

You agree not to use the Service to:

• Violate any applicable local, state, national, or international law or regulation.
• Infringe upon any intellectual property rights or rights of privacy/publicity.
• Submit content that is unlawful, threatening, abusive, defamatory, or that promotes violence, discrimination, or illegal activities.
• Interfere with or disrupt the security or performance of the Service.

7. Subscription Plans, Payment, and Refund Policy

1. Subscription Plans: Vear offers free and premium ("Pro") subscription plans with various usage limits and features. You can find details of current subscription tiers and pricing on our Site.
2. Billing: If you choose a paid subscription, you agree to provide a valid payment method. By subscribing, you authorize Vear (or our third-party payment processor) to charge your chosen payment method for all applicable fees, including recurring subscription fees.

Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE. VEAR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VEAR, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. IN NO EVENT SHALL VEAR'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100.00) OR THE AMOUNT YOU PAID VEAR IN THE PAST SIX MONTHS FOR THE SERVICE.

11. Indemnification

You agree to defend, indemnify, and hold harmless Vear, its affiliates, directors, officers, employees, and agents from and against all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service;
• Any User Content you submit;
• Your violation of these Terms or any applicable law.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of laws principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the state or federal courts located in Missouri. You waive any and all objections to the exercise of jurisdiction over you by such courts.

13. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or for any other reason. Upon termination, your right to use the Service will immediately cease.
